1. Disclaimer of Liability: While every effort is made to ensure the safety and preservation of all photographs, New Leif Photography is not liable for any loss or damage to photos due to unforeseen technical failures, accidents, or other factors outside of their control.
2. Photographer Responsibilities: The photographer is responsible for ensuring that the correct files are delivered to the client in the agreed-upon format (e.g., digital files, prints, etc.). In the event of a delivery error, the photographer will make every effort to correct the situation promptly. The determination of “damaged items” is the responsibility of New Leif Photography.
3. Mail Carrier Services: New Leif Photography uses a reliable shipping service (e.g., USPS, FedEx, UPS) to send printed materials, albums, or other physical products to customers. Delivery times are estimated but not guaranteed, and shipping delays or issues may occur due to factors beyond our control. Once physical products (prints, novelties, etc.) are shipped, New Leif Photography is not responsible for any loss, damage, or delay caused by the shipping carrier. In the event that a package is lost or damaged during transit, New Leif Photography will take the following steps:
- If tracking is available, New Leif Photography will track the order with the mail carrier to determine if the package has been delayed or delivered.
- Offer a replacement set of photos or products, if applicable.
- Provide a partial or full refund on the affected items, excluding shipping fees, if the package cannot be recovered.
- Issuing replacement items or refunds are at the full discretion of New Leif Photography.
4. School Deliveries: Once physical products (prints, novelties, etc.) are shipped & delivered to the school, New Leif Photography is not responsible for any lost or damaged items. In the event that a package is lost or damaged, the following steps will be taken:
- New Leif Photography will track the shipment to determine if it has been delivered to the school.
- New Leif Photography will ask the customer to contact and check with the school regarding the whereabouts of the package.
- Offer a replacement set of photos or products, if applicable.
- Provide a partial or full refund on the affected items, excluding shipping fees, if the package cannot be recovered.
- Issuing replacement items or refunds are at the full discretion of New Leif Photography.
5. Customer Responsibilities: After New Leif Photography has fulfilled their delivery responsibilities, New Leif Photography is not responsible for any loss, damage, or mishandling of photos by the client or any third parties. The following are the responsibilities of the customer:
- Once the product is delivered to the customer, the customer assumes responsibility for the item(s). Customers must notify New Leif Photography within 5 days of receiving damaged items. Lost orders must be reported to New Leif Photography within 30 days of the date of order. Any claims for damage or loss that are not reported within their required time frames may not be eligible for a refund or replacement.
- If the customer has received damaged items, it is the responsibility of the customer to provide proof of the damage before any replacement or refund can be issued.
- It is the client’s responsibility to ensure that the correct mailing address is provided to New Leif Photography at the time of ordering. New Leif Photography is not responsible for misdeliveries due to incorrect or incomplete addresses provided by the client. If a package is returned due to an incorrect address, the client will be responsible for the reshipping cost.
6. Exclusion: New Leif Photography will not be held responsible for lost or damaged packages after they have been delivered, provided the delivery was completed successfully and the items were accessible at the time of delivery. Other exclusions are listed below:
- Refunds will NOT be given due to “not liking a photo” or selecting an incorrect photo after the buyer has already received the photograph.
- If the customer’s device is unable to open or view the files due to their own technical issues (e.g., incompatible software, lack of storage space, etc.).
- Due to the nature of digital photography files and the fact that photographs, once sent, cannot be returned; New Leif Photography has a strict NO REFUNDS POLICY.
- If a pattern of order replacement and/or refund requests from one customer is determined by New Leif Photography, New Leif Photography reserves the right to refuse replacements and/or refunds on all future purchases from that customer. The amount considered a “pattern” is situational and will be determined by New Leif Photography.
